Terms of Service

1. Acceptable Use

By using CedCast, you agree to use the platform only for legitimate business communications. Specifically:

  • You may only send SMS messages to recipients who have given consent to receive communications from your organization.
  • You must have a lawful business relationship with all SMS recipients.
  • Every message must clearly identify the sending organization so recipients know who contacted them.

2. Prohibited Content (Zero Tolerance)

The following types of content are strictly prohibited and subject to immediate enforcement action:

  • Fraudulent Alerts: Fake bank alerts, lottery scam messages, impersonation of government agencies, fake package or delivery notices, or any other deceptive notifications.
  • Phishing: Messages designed to trick recipients into revealing personal information, passwords, financial details, or account credentials.
  • Spam: Unsolicited commercial messages sent to recipients who have not opted in to receive communications from your organization.
  • Illegal Content: Any content that violates the laws of the Republic of Ghana, including the Electronic Communications Act, 2008 (Act 775) and related regulations.
  • Impersonation: Pretending to be another organization, person, or government body that your organization is not.
  • Financial Scams: Fake mobile money alerts, bogus investment schemes, advance-fee fraud ("419" scams), or any message designed to defraud recipients financially.
  • Harassment: Threatening, abusive, defamatory, or otherwise harmful content directed at any individual or group.
  • Misleading Sender IDs: Using a sender name that misrepresents the true origin of the message or impersonates a known brand, institution, or government agency.

3. Automatic & Permanent Ban

CedCast operates a zero-tolerance policy for prohibited content. Violations result in:

  • Immediate and permanent account suspension without prior warning when fraudulent or prohibited activity is detected.
  • Forfeiture of SMS credit balance — no refunds will be issued on account termination for cause.
  • Reporting to the NCA: Organization details and evidence of violations will be reported to the National Communications Authority (NCA) of Ghana.
  • No re-registration: Banned organizations and their principals may not register new accounts on the CedCast platform.

CedCast reserves the right to act swiftly and without notice when fraud or abuse is detected in order to protect the public and the integrity of the platform.

4. Content Monitoring

  • CedCast may review message content for compliance with these Terms of Service and applicable law.
  • Automated systems continuously flag suspicious sending patterns, unusual recipient volumes, and message content that matches known fraud templates.
  • CedCast will cooperate fully with law enforcement and regulatory authorities, including providing message logs and account details when lawfully required.

5. Account Responsibility

  • You are fully responsible for all messages sent from your CedCast account, whether sent by you directly or by any user you have granted access to.
  • You must keep your login credentials secure and must not share them with unauthorized persons.
  • You must immediately report any suspected unauthorized access to your account by contacting CedCast support.
  • Organization administrators are responsible for all actions taken by sub-users they create or grant access to within their organization.

6. SMS Credits & Billing

  • Non-refundable: SMS credits purchased are non-refundable except at CedCast's sole discretion.
  • Per-segment pricing: SMS are billed per message segment based on your organization's current volume tier.
  • Pricing changes: CedCast will provide at least 30 days' notice before any change to pricing tiers takes effect for existing accounts.
  • Welcome/trial credits: Free credits awarded at signup expire as stated at the time of award and are non-transferable.

7. Sender ID Usage

  • Default sender: All new accounts are assigned the shared CEDCAST sender ID. Messages sent using this ID are delivered on behalf of CedCast.
  • Custom sender IDs: Custom alphanumeric sender IDs must accurately represent your organization. Misleading or impersonating sender IDs will not be approved and will be revoked if discovered after approval.
  • CedCast reserves the right to revoke any sender ID — including custom IDs — that violates these Terms of Service or applicable regulations.

8. Data & Privacy

  • Use of CedCast is also governed by our Privacy Policy, which is incorporated into these Terms by reference.
  • You are solely responsible for obtaining valid consent from your SMS recipients in compliance with applicable law before sending them messages through CedCast.
  • You must comply with Ghana's Data Protection Act, 2012 (Act 843) and any other applicable data protection legislation when collecting, storing, and using recipient contact information.

9. Service Availability

  • CedCast does not guarantee 100% platform uptime. Scheduled maintenance and unforeseen outages may occur.
  • SMS delivery depends on third-party SMS gateway providers and mobile network operators. CedCast is not liable for delivery failures caused by third-party networks.
  • CedCast will make reasonable efforts to notify users of planned maintenance in advance.

10. Termination

  • By you: You may close your account at any time by contacting CedCast support. Unused credits remaining at the time of voluntary closure are non-refundable.
  • By CedCast: CedCast may suspend or terminate your account for violation of these Terms, non-payment, or any reason that CedCast determines poses a risk to the platform or its users.
  • Credits forfeited on cause-based termination: If your account is terminated for violation of these Terms, all SMS credits are forfeited and no refund will be issued.

11. Limitation of Liability

  • CedCast's total liability to you for any claim arising out of or related to your use of the platform is limited to the total amount you paid to CedCast in the twelve (12) months immediately preceding the claim.
  • CedCast is not liable for any indirect, incidental, consequential, special, or punitive damages arising from your use of or inability to use the platform, even if CedCast has been advised of the possibility of such damages.

12. Governing Law

  • These Terms of Service are governed by and construed in accordance with the laws of the Republic of Ghana.
  • Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Kumasi, Ashanti Region, Ghana.
Zero-Tolerance Fraud Policy

CedCast maintains a strict zero-tolerance policy against fraudulent, phishing, and spam messaging. Violations result in immediate permanent account suspension, forfeiture of all SMS credits, and reporting to the National Communications Authority (NCA) of Ghana. There are no warnings and no appeals for fraud-related bans.
